Do I Have a Civil Assault Case?

Assault isn’t just a crime in Arizona. It can also give rise to a civil lawsuit. You may have a claim if someone intentionally harmed you or caused you to reasonably fear harmful or offensive contact.

You might have an assault case if you were:

  • Threatened by another person with a weapon
  • Mugged or robbed
  • Punched or struck by another person
  • Hit by an object thrown at you

You do not necessarily have to suffer physical injuries to pursue a civil assault claim. The circumstances of the incident will determine whether you have grounds to seek compensation.

Who Could Be Liable for My Assault?

The person who assaulted you may be liable, but other parties could also share responsibility. Depending on the circumstances, potentially liable parties may include:

  • The attacker: The person who committed the assault may be held responsible for the harm they caused.
  • Property owners: A property owner may be liable if inadequate security contributed to a foreseeable assault.
  • Businesses: Bars, restaurants, nightclubs, and other businesses may face liability when they fail to take reasonable security measures.
  • Employers: An employer may be responsible in some cases when an employee commits an assault in connection with their employment.

Determining who is responsible can help identify the parties from whom you may be able to recover compensation.

AJ Law, PLC has it handled, and we’re ready to invest our considerable experience and resources into your assault case so that you can get justice when you need it most.

How Much Is My Assault Injury Claim Worth?

A lot goes into determining how much money you might be able to get when you pursue a civil assault lawsuit in Phoenix.

Our team will consider:

  • The specific physical injuries you’ve sustained and their level of severity
  • How long your medical team believes you’ll need treatment
  • Estimated timeframe for reaching maximum medical improvement (MMI)
  • Where you were when you were assaulted
  • How much time at work you’ll miss
  • Changes in your income and earning capacity, now and in the future
  • How being assaulted has shaped your relationships, affected your ability to live your life, and the extent ot which you struggle with anxiety, depression, and other emotional distress

The more the assault disrupts your life and puts you in financial distress, the more our assault injury attorneys in Phoenix can pursue for you in monetary damages. We’ll work closely with experts to evaluate the financial implications of the assault, as well as the toll this traumatic experience has and will take on your ability to live your life.

We won’t rest until your attacker and anyone else who can be held accountable make things right by making you whole.

Types of Damages Available to Assault Victims in Phoenix

Assault victims in Phoenix can usually pursue two classes of monetary awards: compensatory and punitive.

Compensatory damages include awards for economic losses and non-economic losses, including:

  • Current and future medical treatment
  • Lost wages and disability
  • Diminished earning capacity
  • Long-term care and assistance
  • Rehabilitation
  • Out-of-pocket expenses
  • Funeral expenses if an assault is fatal
  • Pain and suffering
  • Emotional distress
  • Loss of consortium
  • Reduced quality of life
  • Post-traumatic stress disorder
  • Disfigurement
  • Embarrassment
  • Chronic physical pain

Punitive damages may also be available in some assault cases. These damages are meant to punish a defendant for especially harmful behavior. In Arizona, they may be awarded when there is clear evidence that the defendant intended to cause harm or acted with a conscious disregard for the safety of others.

What Does It Cost To Pursue an Assault Claim?

Justice doesn’t cost a thing out of pocket. Our Phoenix assault injury attorneys handle cases on a contingency fee basis. We front the costs of pursuing the assault injury case and only get paid when we win. Our fee is a percentage of the financial recovery, agreed upon before representation begins.

If we don’t recover compensation for your assault injury, you owe us nothing. There’s no risk in asking for our help, so contact us to discuss your situation today. We’ll listen to your story, answer your questions, and explain how we might be able to help you achieve the results you desire.

Is There a Statute of Limitations for Civil Assault Lawsuits in Arizona?

Generally speaking, you have two years from the date you’re assaulted to file a civil assault lawsuit with a court in Arizona. There are exceptions, however. If you’re suing a government agency, you must generally file a notice of claim with the government within 180 days of being assaulted. This notice requirement must be met for your government tort claim to survive.

Cases involving minors are also subject to different rules. Since a minor doesn’t have the legal capacity to bring a case before an Arizona court, the statute of limitations can be tolled until they do. This effectively means that a child victim of assault has until their 20th birthday to pursue an assault injury lawsuit.

Don’t stress about notice requirements, filing deadlines, or other procedural aspects of your assault injury lawsuit. Pick up the phone and call AJ Law, PLC for help as soon as you can.
